AirAsia, AirAsia X sue MAHB for RM480m

KUALA LUMPUR: AirAsia Group Bhd has sued Malaysia Airports Holdings Bhd for RM479.78 million.

AirAsia said the group and AirAsia X Bhd had on October 2 filed a writ of summons at the Kuala Lumpur High Court against MAHB’s wholly-owned Malaysia Airports (Sepang) Sdn Bhd (MASSB) for RM479.78 million.

In a filing to Bursa Malaysia today, AirAsia said the claims was made for the loss and damage caused by negligence on the part of MASSB, its servants and/or agents in the management, operation, maintenance and/or provision of airport services and facilities at klia2.

AirAsia and AirAsia X had earlier sought mediation by the Malaysian Aviation Commission (Mavcom) on their dispute with MASSB, in accordance with Sections 74 to 78 of the Mavcom Act.

Mavcom refused to mediate, and a subsequent attempt by AirAsia to seek a judicial review of the commission’s inaction was dismissed.

In a separate statement, AirAsia chief executive officer Riad Asmat and AirAsia X CEO Benyamin Ismail said: “We did not want to do this but Malaysia Airports and Mavcom have forced our hand. Despite our best efforts to settle this matter amicably and through the right channels, we feel compelled to file this claim as we were left with no other recourse to protect our interests.”

They claimed that the dispute had all started when MAHB filed a civil suit against the group over passenger service charges after rejecting the latter’s offer to go for mediation.
