KUALA LUMPUR: The Sessions Court in Melaka has dismissed a claim involving two youths against Liberty Insurance Bhd following a motorcycle accident they purportedly had with a motorcar insured by the insurance company.
The plaintiffs, Mageshwaran and Darwin Kumar, had apparently suffered multiple fractures in this alleged mishap.
The Sessions Court Judge, Elesabet Paya Wan dismissed the claim with cost after hearing evidence from witnesses, going through exhibits and the written submissions.
The Judge found that the motorcar insured with Liberty Insurance was not involved in the accident.
The Court had also allowed Liberty Insurance's counter-claim against the two youths with cost, declaring that the policy is unenforceable.
Liberty Insurance has appointed Messrs Veni & Associates to defend it's insured and Messrs Naicker & Associates to intervene to protect the rights of Liberty Insurance.
The two youths were represented by Surendran Chelvarajah of Messrs Sekar Gill & C Suren.
