Three charged in Johor court for selling fake baby milk [NSTTV]

JOHOR BARU: Three individuals were charged in the Johor Baru Sessions Court today for selling and distributing fake baby formulas.

The three individuals – Yap Kai Chai, 59, Ling Mei Nar, 42, and Yap Chang Hong, 26 – were identified as business partners of a string of Chinese medicinal drug stores, operating in several locations in the state.

On the first count, Kai Chai and Ling, as business partners of TCM Yongtai Lian in Taman Mutiara Rini, Skudai had allegedly committed the offence of openly selling fake Enfalac A+ Step 1 (1.8 kg), which was found with counterfeited trademark on the product packaging.

On the second charge, Kai Chai had committed the same offence, this time with his son Chang Hong, his business partner of the Yong Thye Lian drug store in Taman Nusa Bestari, Skudai.

If found guilty, both offences, read under Section 8 (2)(b) of the Trade Description Act 2011 carries a fine of up to RM10,000 for each of the traded good or imprisonment of up to three years or both.

The father and son were also charged with possession of a total of 208 packs of fake baby formulas, which was stored at another business outlet in Taman Seri Orkid.

All of the alleged offences were committed on Dec 7, 2017 at 1pm when a team from the Domestic Trade, Co-operatives and Consumerism Ministry’s office in Johor carried out checks at the shops operated by the three, following public complaints of fake baby formulas being sold in the state.

The three pleaded not guilty and claimed trial before Sessions Court judge Jailani Rahman.

Lydia Salleh from the ministry prosecuted, while the three accused were represented by lawyer C S Lim.

The court fixed March 23 for mention.
