PETALING JAYA: A 51-year-old man was today sentenced to 29 years’ jail and 20 strokes of rotan by the Sessions Court for raping and committing incest on his stepdaughter since four years ago.
Judge Hilmiah Yusof meted out the sentence to the man who pleaded guilty to both charges.
Dressed in black shirt, the accused uttered ‘ya.. salah’ (yes.. guilty) when the charge was read and kept his head down throughout the proceeding.
For the charge of raping, the court sentenced the accused to a 14 years’ jail and 12 strokes of cane, and another 15 years’ and eight counts of whipping for the offence of incest.
The court ordered the jail terms to run consecutively from the date of arrest on Oct 1.
For the first offence, the accused was charged with raping the girl, who was 19, at an apartment in Seri Kembangan, between 2014 and Aug 26 this year.
For the second offence, he was accused of raping and committing incest on the victim when she was 15 at the same location.
He was charged under Section 376(3) of the Penal Code for rape which carries a maximum penalty of 30-year imprisonment and 10 counts of whipping.
For incest, the charge was framed under Section 376(A) of the Penal Code and punishable under Section 376B of the same Act, which carries a maximum penalty of 30 years’ jail and whipping.
Deputy Public Prosecutor Shafiq Hasim earlier asked the court to impose a heavy penalty on the accused for his heinous crime.
He said the accused, who was the family head, was entrusted to protect the victim, had instead wrecked her future.
“This is the most disgusting case I have ever conducted and based on the facts of case, there were countless rape offences committed against the victim that the court could not even keep a tally,” he said.
The accused, who was unrepresented, appealed for a lenient sentence as he was the sole breadwinner in the family and had to care for his wife and three children.
According to the facts of case, the accused had entered the victim’s locked room using a spare key and raped her.
The accused did this once a month and the crime went on until the victim turned 19.
The victim, who could no longer stand the atrocious act of her stepfather, complained to her elder sister who later brought her to the police station.
Checks by the doctor revealed old tear in the victim's hymen on the victim’s private part.
