KUALA LUMPUR: The High Court today lifted the gag order against the producer of the banned controversial indie movie "Mentega Terbang" which prevented him from issuing a public statement about his criminal trial.
Lawyers for Liberty (LFL) in a statement said High Court judge Datuk Mohd Jamil Hussin made the ruling after hearing submissions from both parties today.
The statement said the court ruled that the magistrate who gave the order failed to disclose any obvious or imminent threat to the fairness of the trial.
The group said the respondents (prosecution) failed to satisfy that there is a real and substantial risk to the fairness of the trial.
On Jan 19, Tan Meng Kheng together with the film's director Mohd Khairianwar Jailani filed a revision application to challenge the directive issued by two separate magistrate's courts on Jan 17.
The duo was charged with deliberate intention of wounding the religious feelings of others last year through the movie.
They claimed trial to the charge in their roles as producer, director and scriptwriters of the movie before magistrates Noorelynna Hanim Abd Halim and Aina Azahra Arifin.
They committed the offence at a unit at Diamond Regency, Jalan Semarak Api 2 at 12.34pm on Feb 26 last year.
It carries jail of up to one year; fine or both.
