MUAR: A private educational institution warden, 19, pleaded not guilty today to three charges of physical sexual misconduct against a male student in Kluang.
The charges were read separately by a court interpreter before Sessions Court judge Sayani Mohd Nor.
The charges allegedly occurred between last year and January this year.
According to the first charge, the accused is alleged to have committed the act against a student, 12, who resides at the institution, behind a toilet at 1am in late November .
The charge falls under Section 14(a) of the Sexual Offences Against Children Act 2017.
For the second and third charges, the accused is alleged to have assaulted the same victim between 1am and 2am during the same period.
The alleged incidents reportedly took place behind a toilet and in a room in the dormitory.
According to the police report, the victim fled the institution, which prompted a missing person's report to be filed.
However, after victim was found, he claimed he ran away because he could no longer endure the accused's actions.
The victim's mother lodged a police report at the Kluang police headquarters on Aug 16, which led to the suspect's arrest on the same day.
The prosecution was led by deputy public prosecutor Danial Munir, while the accused was represented by Syafie Naim.
The court set Sept 26 for further mention and submission of documents from the prosecution.
The court granted bail of RM15,000 with one surety and imposed two conditions: the accused must report to the nearest police station at the beginning of each month, and is prohibited from approaching, contacting or communicating with the victim until the proceedings are concluded.
