[UPDATED] GISB CEO, wife file habeas corpus application in Johor High Court

JOHOR BARU: Global Ikhwan Services and Business (GISB) Holdings Sdn Bhd chief executive officer Datuk Nasiruddin Mohd Ali and two others have filed a habeas corpus application in the High Court here today to challenge his detention under the Security Offences (Special Measures) Act or Sosma.

Apart from Nasiruddin, also filling out the same application were his 57-year-old wife Datin Azura Md Yusof and Mohamad Suhaimi Mohd Sani, 28.

Mohamad Suhaimi is expected to be charged under Sosma at the Sessions Court in Kota Tinggi later today.

The application was filed by a team of lawyers led by Datuk Rosli Kamaruddin, Najib Zakaria, Boestamam Ahmad, and Dorina Abdullah.

In the application, Nasiruddin, Azura, and Suhaimi named the Home Minister, the Inspector-General of Police, the Public Prosecutor, the Selangor and Kuala Lumpur Prisons Department directors as well as the Government of Malaysia as respondents.

According to the application, an order is sought for a writ of habeas corpus to be issued to free the three from the unlawful arrest and detention by the respondents.

Judge Datuk Abu Bakar Katar set Dec 4 to hear the application and to allow the lawyers representing the three and respondents to present their arguments.

Later when met at the compound of the court complex, Rosli said a similar application would be filed in Selangor and Kuala Lumpur soon.

"We are filing the habeas corpus application starting in Johor Baru because the investigation also involves cases here and some of the business premises under investigation are located here.

"This is the right of the accused to challenge the detention, and there will also be an application made to contest the charges under organised crime.

"There are several more affidavits that will be filed to support the habeas corpus application before the hearing resumes on Dec 4," he said.

It was reported that Nasiruddin Mohd Ali and Azura were charged at the Sessions Court on Oct 23 with being members of an organised criminal group.

They were accused of being members of the organised criminal group under GISB between Oct 2020 to Sept 11 this year at Bandar Country Homes in Rawang, Selangor. 

They were charged under Section 130V(1) of the Penal Code, which carries a jail term of not less than five years and a maximum of 20 years.
