'Prosecution will inform court about Daim's death next week'

KUALA LUMPUR: The prosecution will inform the Sessions Court about former finance minister Tun Daim Zainuddin's death next week.

Judge Azura Alwi is set to give her verdict on Nov 20 over the prosecution's application for Daim to undergo a mental evaluation to assess whether he is fit for trial.

Deputy public prosecutor Law Chin How said this when contacted today.

The prosecution filed the application after the 86-year-old statesman failed to attend any court proceedings following his charge for non-compliance with a Malaysian Anti-Corruption Commission (MACC) notice.

He was charged with failure to declare his assets, including a bank account, seven luxury vehicles, 38 companies and 25 properties, at the MACC headquarters in Putrajaya on Dec 13 last year.

The offence falls under Section 36(2) of the MACC Act, which carries a maximum five years' jail and RM100,000 fine upon conviction.

When asked about the status of Daim's assets that were frozen by the MACC, Law said he was awaiting further instructions from the agency.

On June 6, Daim and his family filed a judicial review to have MACC unfreeze their bank accounts. The hearing is set to commence at the High Court on Dec 9.

Daim and his family are seeking an order to set aside the MACC's seizure of their movable assets under Section 50 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.

Besides Daim, the applicants include his wife, Toh Puan Na'imah Abdul Khalid, and their four children, Asnida, Wira Dani, Muhammed Amir Zainuddin and Muhammed Amin Zainuddin.

On March 4, the High Court struck out the initial judicial review application filed by Daim and his family over the MACC's investigation on the grounds that the applicants failed to prove malicious intent by the agency's officers.

Daim died this morning. The businessman turned politician was finance minister from 1984 to 1991 and again from 1998 to 2001.
