Jan 16 decision on ex-civil servants' pension adjustment suit

KUALA LUMPUR: The High Court has set Jan 16 next year to deliver its decision on a class action lawsuit led by pensioner Aminah Ahmad, who is seeking for the government to expedite pension adjustments in line with a previous court ruling.

This follows a postponement of the decision that was initially scheduled for today.

Judge Datuk Amarjeet Singh said he needed more time to reach a verdict.

Aminah's lawyers, Datuk Dr Shukor Ahmad and Datuk Baljit Singh Sidhu, were informed of the adjournment this morning.

They noted that some clients, who had travelled from Johor, were disappointed by the delay.

The case stems from Aminah's efforts to compel the government to adjust pensions in accordance with Sections 3 and 6 of the Pensions Adjustment Act 1980 (PAA), which was amended in 2013.

Prior to the amendment, pension adjustments were based on the salaries of current civil servants in the same grade.

The 2013 amendment introduced a flat-rate annual increment of 2 per cent.

Aminah's initial suit was dismissed by the High Court in 2020, but the Court of Appeal later overturned the decision, ruling the 2013 amendments were unconstitutional as they put pensioners at a disadvantage.

The Federal Court upheld this ruling on June 27 last year.
