Restaurant worker jailed 7 years for sexually assaulting minor, making obscene gestures

MUAR: A restaurant worker was sentenced to five years in prison and two strokes of the cane for sexually assaulting a 15-year-old girl.

Hamdan Mohammad, a 45-year-old father of two, was also sentenced to two years' jail for making obscene gestures at the girl.

The court also mandated that Hamdan undergo two years of police supervision upon his release.

Judge Sayani Mohd Nor meted out the sentences after the accused pleaded guilty to the two charges.

Hamdan was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, for sexually assaulting the girl on June 28 at the restaurant where he worked.

The offence carries a maximum penalty of 20 years imprisonment and caning.

Hamdan was also charged with showing obscene gestures to the victim on May 22 at the same location, an offence punishable under Section 15(a)(i) of the same act.

The court heard that Hamdan had also sent the victim suggestive messages.

He assaulted her at the restaurant at 6.30pm. She lodged a police report on the assault on July 8.

Deputy public prosecutor Danial Munir prosecuted while Hamdan was unrepresented.
