KOTA KINABALU: Tan Sri Musa Aman today filed an originating summons against Yang di-Pertua Negeri Tun Juhar Mahiruddin and Parti Warisan Sabah (Warisan) president Datuk Seri Mohd Shafie Apdal over who is the rightful Sabah Chief Minister.
The originating summons, supported by an affidavit, was filed at the High Court through his lawyer Tengku Fuad Tengku Ahmad.
In his summons, Juhar has been named as the first defendant and Shafie the second defendant.
Musa has discontinued the writ of summons filed against the duo on May 17.
“The Notice of Discontinuance is for the writ of summons filed earlier. An originating summons has been filed today and supported by an affidavit. The case is still on,” Tengku Fuad said when contacted.
According to the originating summons, all parties concerned are to appera before the Judge in Chambers on July 9 at 9am for the hearing of an application by the plaintiff.
The summons are on the matters of the appointment of the Sabah chief minister, the exercise of the powers of the Yang di-Pertua Negeri, and Articles 6(3) and 10(2) of the Sabah state constitution.
On May 10, Musa was sworn-in as chief minister before Juhar after obtaining a 31 vote majority to form the state government when Parti Solidariti Tanah Airku formed working ties with Sabah Barisan Nasional (BN).
However, Warisan-Pakatan Harapan pact took over Musa-led goverment after Upko pulled out from BN coalition and several BN assemblymen supported Shafie, who was sworn-in as chief minister on May 12.
