Serba Dinamik takes KLSE Screener owner to court

KUALA LUMPUR: Serba Dinamik Holdings Bhd and its group managing director and chief executive officer Datuk Mohd Abdul Karim Abdullah have taken the owner and operator of KLSE Screener to court for alleged publication of false and defamatory comments posted by a user account impersonating the group's CEO.

Serba Dinamik said a user account, who went by the name of "Dato' Mohd Karim", had allegedly published false comments on the website klsescreener.com which led to "undesirable speculations" on Serba Dinamik stocks.

Serba Dinamik chairman Datuk Mohamed Ilyas said an ad interim injunction was obtained by the company and Mohd Karim against Lim Kai Yang, the owner and operator of KLSE Screener.

"The interim injunction shall serve to restrain KLSE Screener from publishing, republishing or allowing any publication of false comments by any account impersonating Datuk Mohd Karim or Serba Dinamik Holdings Bhd.

"The company views such impersonation and publication of false comments as serious offences against the company and its CEO. These false comments have created unwanted speculations on Serba Dinamik Holdings which jeopardizes and destroys the goodwill and reputation of the company as well as Datuk Mohd Karim," Ilyas said in a statement.

Ilyas said Serba Dinamik would continue to monitor several other platforms and necessary legal actions would be taken against them in due course if they publish false and defamatory articles against the company.

The company said the court had on July 27 this year granted Serba Dinamik and Mohd Karim an ex parte injunction order against Lim to restrain him from publishing, republishing or allowing any publication of false comments by any account impersonating Mohd Karim or Serba Dinamik until August 5.

An ad interim injunction order was granted on August 5 this year where the court extended the injunction order until the inter partes hearing of the injunction application.

In the application filed together with the writ of summons, the company applied for an interim injunction to restrain the owner and operator of KLSE Screener or his agent or representative from publishing and republishing the false comments by any account impersonating Mohd Karim or Serba Dinamik statements on the latter's page.

Serba Dinamik and Mohd Karim filed the application on the grounds that the statements by klsescreener.com were false, defamatory and had tarnished the reputation and the good name of the company as well as the group CEO locally and internationally.

"The ad interim injunction will remain valid until the disposal of the inter parties hearing of the injunction application on October 15 2021," it said.
