GCH says Giant Batu Caves tenancy dispute with landlord still being contested in court

KUALA LUMPUR: GCH Retail (Malaysia) Sdn Bhd, the operator of Giant hypermarkets, says the court is still deliberating on the company's tenancy dispute with its landlord over premises in Batu Caves.

The dispute, initiated by TF Value-Mart Sdn Bhd against GCH Retail, is currently being vigorously contested in the High Court. 

"It is sufficient to state that the matter (civil case instituted by TF Value-Mart) is currently pending before the High Court, and it's being vigorously contested and absolutely rebutted on all issues raised therein," it said in a statement. 

GCH Retail said it had appealed against a court order to surrender the 180,000 square feet premises, following a summary judgement obtained by its landlord Crystal Promenade Sdn Bhd.

The company is also appealing the dismissal of its suit against the landlord for alleged breach of contract and disruption of its operations, as well as the dismissal of its bid for an interim injunction to restrain the landlord from interrupting its operations at the disputed premises.

"In conclusion, the press statement by TF Value-Mart Sdn Bhd commenting on the orders obtained in the High Court without mentioning the pending appeals and the stay application, amounts to a serious interference of the administration of justice, especially as all these live issues are presently sub judice'" it added.
