It was on a dare, says driver charged with ramming into police roadblocks

IPOH: A 26-year-old man is facing two charges of attempted murder of three policemen last month.

Mohammad Aguib Roslan who is also a part-time lorry driver pleaded not guilty at the Session's Court when the charges were read before Judge Azman Abu Hassan.

For the first charge, Mohammad Aguib was accused of ramming into a roadblock in Jalan Sultan Nazrin Shah (Chandan Desa), Simpang Pulai here at 10.30am.

He was accused of speeding in his vehicle which could cause the death of Corporal Mohd Hasanudin Hassan, who was manning the roadblock.

For the second charge, Mohammad Aguib was accused of ramming into another roadblock at KM19.7 of Jalan Ipoh-Kuala Lumpur (Kuala Lumpur bound) in Gopeng at 11am, on the same day.

He was accused of speeding in the same vehicle and rammed into the roadblock manned by Lance Corporal Shahrul Muhairi Muha and Lance Corporal Ahmad Shahribi Zainun, in an incident that could have caused the policemen's death.

He was charged under Section 307 of the Penal Code for attempted murder which carries a maximum jail term of 20 years, upon conviction.

Deputy Public Prosecutor Naidatul Athirah Azman pushed for an appropriate bail amount to reflect the seriousness of the charges.

In mitigation, the accused, who was unrepresented, said he was forced to ram into these roadblocks after one of his friends had dared him to do so.

"Since we had rammed into the first roadblock, we might as well go all out and hit the second one," he said.

The court then fixed bail at RM5,000 for two charges and set July 7 for mention.

Later at the Magistrate's Court, Mohammad Aguib and his two other friends, Mohamad Ikhwan Fahmiezie Loddin, 21 and Mohd Ashaduzzaman Mohd Khokon Mia, 22 were also charged with flouting Conditional Movement Control Order (CMCO) and obstructing police officers from carrying out their duties.

Mohammad Aquib was fined RM1,000 in default of three months' jail, while Mohamad Ikhwan and Mohd Ashaduzzaman were jailed three months each for flouting CMCO.

They pleaded guilty for all the charges that were read to them before Magistrate Umzarul An-Nur Umar.

Deputy public prosecutors were Nur Asmaniza Mohammad and Afiqah Izzati Mazlan while the accused were represented by National Legal Aid Foundation lawyer E.P Sittan.

Based on the charge sheet, the accused were travelling in a Toyota Avanza and not from the same house.

They were charged under Rule 9 of the Prevention and Control of Infectious Diseases Act (Measures within the Infected Local Areas) Regulations 2020 which provides for a fine up to RM1,000 or jail not more than six months or both upon conviction.

Mohammad Aquib was also fined RM5,000 in default of four months' jail while Mohamad Ikhwan and Mohd Ashaduzzaman were jailed three months each for obstructing policemen from carrying out their duty at two different locations.

All offences were committed at two separate roadblocks in Jalan Sultan Nazrin Shah (Chandan Desa), Simpang Pulai here and KM19.7 of Jalan Ipoh-Kuala Lumpur (Kuala Lumpur bound), Gopeng between 10.30am and 11am.

They were charged under Section 186 of the Penal Code for obstructing a public servant from carrying out his duties which carries a maximum two years' jail or a fine of up to RM10,000 or both if convicted.

Umzarul An-Nur then ordered Mohamad Ikhwan and Mohd Ashaduzzaman's jail sentence run from the date of their arrest, which was May 27.
