Soldier charged with drink driving

TAWAU: A soldier who caused an accident while drink-driving has been charged in the Magistrate's Court here.

Davison Nyanggau Anak Lawai, 34, of Territorial Army (Askar Wataniah) Regiment 516, pleaded not guilty to the offense before Magistrate Don Stiwin Malanjum.

According to the charge sheet, Davison is accused of drink-driving with alcohol levels above the legal limit on the night of April 25. He allegedly caused an accident that injured a 27-year-old motorcyclist.

The offence is framed under Section 44(1A)(b) of the Road Transport Act for driving under the influence of alcohol or drugs.

If convicted, Davison faces a jail term of up to 10 years and a fine of RM50,000. He will also be barred from driving for 10 years.

The prosecution was handled by Tawau Police Headquarters prosecuting officer, Assistant Superintendent Joan Lee, while the accused was unrepresented.

The court set bail at RM2,000 with two sureties. The trial is scheduled for Dec 18 and 19.

Meanwhile, in a separate case, a fisherman was fined RM10,000 and jailed for a day for drink-driving.

The accused, Wong Tze Fei, 40, was sentenced after pleading to the offence under Section 45 (1) of the Road Transport Act for being in charge of a vehicle under the influence of alcohol or drugs.
