PUTRAJAYA: The son of former Defence Minister Mohamad Sabu, Ahmad Saiful Islam, 34, remains free of a drug abuse charge three years ago.
This follows a unanimous decision by a three-man bench at the Court of Appeal led by Datuk Seri Kamaludin Md Said in dismissing the prosecution's appeal to set aside the High Court's verdict.
The Kuala Lumpur High Court in October last year set aside Ahmad Saiful Islam's drug abuse conviction after the Magistrate's Court sentenced him to eight months' jail.
"The court has weighed the arguments from both sides and disagrees with the prosecution that the High Court judge had erred factually and legally in allowing Ahmad Saiful Islam's appeal.
"The court is satisfied that the High Court judge had weighed all the statements comprehensively and this court finds no doubts in the judge's decision to acquit Ahmad Saiful Islam.
"With that, prosecution's appeal is rejected and the High Court's decision stays," Kamaludin said.
Kamaludin presided over the appeal together with Datuk M. Gunalan and Datuk Hashim Hamzah.
According to the charge, Ahmad Saiful was accused of administering a THC drug (marijuana) at a hotel in Kuala Lumpur at 2.05am on Jan 5, 2019.--BERNAMA
