Najib Razak, Irwan Serigar CBT case: A timeline

KUALA LUMPUR: The Datuk Seri Najib Razak and Tan Sri Mohd Irwan Serigar criminal breach of trust (CBT) case has reached its fifth year following a postponement on the trial date and the High Court's decision to strike out the defence's appeal for a discharge not amounting to acquittal (DNAA) on all charges.

Today, the High Court heard the purported leaked 12-page memo that has been circulating online, recommending the dropping of the RM 6.6 billion CBT case against Najib and Irwan.

Here is a timeline of the case:

Oct 25, 2018 - Former prime minister Datuk Seri Najib Razak and former treasury secretary-general Tan Sri Dr Mohd Irwan Serigar Abdullah were charged at the Sessions Court with six counts of criminal breach of trust (CBT) involving over RM6.6 billion of government funds.

Dec 7, 2018 - High Court judicial commissioner Datuk Rozana Ali Yusof allowed an application by Najib's and Irwan's lawyers to have the case transferred from the Sessions Court to the High Court.

Dec 18, 2019 – The then High Court judge Mohd Nazlan Mohd Ghazali vacated the trial dates for January and February 2020, to make way for the former prime minister's ongoing SRC International Sdn Bhd trial which has entered the defence stage.

March 2, 2022 – High Court Judge Datuk Muhammad Jamil Hussin struck out Najib and Irwan's application to be discharged not amounting to acquittal for all charges. The duo made the application when there were no updates of the proceedings.

April 3, 2023 - The prosecution seeks postponement of the case due to recent developments of the case. The Attorney-General's Chambers received a fresh representation letter from Irwan's lawyer, Datuk K. Kumaraendran, last month.

Aug 9, 2023 – Najib sent his second representation letter to quash the charges. Deputy Public Prosecutor Muhammad Saifuddin Hashim Musaimi told the High Court that the AGC received Najib's application last week.
