TANAH MERAH: The Syariah Lower Court here today ruled that a marriage between a woman and businessman remained intact after his wife had committed polyandry by marrying another man.
Judge Ahmad Hariri Mohd Saat made the decision after Rahaman Mohamed Jaafar, 47, swore that he had not divorced his wife with three 'talak' as alleged.
"According to the defendant's oath, the defendant and the plaintiff still remain husband and wife unless there is new evidence presented by the plaintiff," Ahmad Hariri said when reading out the divorce decree between Rahaman and Wan Nor Shakirin Wan Abdul Razak, 32.
The court then set Oct 22 as the date for the mention of the divorce application filed by Wan Nor Shakirin.
Rahaman, when met, said he was grateful for the court's ruling that he and his second wife were still married.
"Alhamdulillah, I dare to swear under oath because I have never pronounced a 'talak tiga' as claimed by my wife.
"What can I say, until now I still love my second wife despite her marrying another man.
"Even if my wife files for divorce, I will not let her go because my love for her is still strong," he said.
It was previously reported that a woman had committed polygamy after her second marriage was discovered by her first husband.
Rahaman revealed that he married his 32-year-old wife in January 2019 in Narathiwat, Thailand before his wife disappeared from home in January this year.
He said that their marriage was confirmed in accordance with Syariah law by the Lower Syariah Court of Tanah Merah, on June 6 and was registered at the Tanah Merah Islamic religious office.
However, he added that he was surprised to learn that his wife married another man last April.
Meanwhile, Rahaman's lawyer, Marzuqi Muhamad, said the court today ruled that his client's marriage was still intact and set October 22 for the divorce application filed by the plaintiff.
