PETALING JAYA: Lawyer Fahmi Abd Moin confirmed today that investigations into the tragic murder of 6-year-old Zayn Rayyan Abdul Matiin will still continue under Section 302 of the Penal Code.
Despite the parents being charged under Section 31 of the Child Act and released on bail, Fahmi said that the police were continuing their pursuit of the real perpetrator.PETALING JAYA: Lawyer Fahmi Abd Moin confirmed today that investigations into the tragic murder of 6-year-old Zayn Rayyan Abdul Matiin will still continue under Section 302 of the Penal Code.
Despite the parents being charged under Section 31 of the Child Act and released on bail, Fahmi said the police were continuing their pursuit of the real perpetrator.
"The investigation commenced under Section 302 of the Penal Code, and although both individuals have been released on bail, they have been formally charged under Section 31 of the Child Act 2001.
"However, the investigations under Section 302 will not stop. The police will continue the investigation to find the real perpetrator," said Fahmi, who is representing Zayn Rayyan's father Zaim Ikhwan Zahari, during a press conference at the Petaling Jaya Court Complex today.
Meanwhile, Mahmud Jumaat, the lawyer representing the mother, Ismanira Abdul Manaf, said the reason the court changed the section of the charge from Section 302 of Penal Code to Section 31 of the Child Act may be based on the evidence and the statements from the witnesses.
When asked about the possibility of reverting to the charge under Section 302, Mahmud said, "We cannot comment on that as it falls within the jurisdiction of the prosecutor.
"I believe it's enough for anyone to speculate their involvement in this case,"
Regarding the reason for the charges of negligence, Fahmi said that neither he nor Mahmud had received documents detailing further specifics of the matter today.
He said the documents might be provided during the next court mention scheduled on July 26.
Earlier, the parents of autistic boy were charged at the Sessions Court with neglect of their six-year-old son which may have caused him physical injuries last year.
The couple Zaim and Ismanira, both aged 29 said they understood the charge and pleaded not guilty before judge Dr Syahliza Warnoh.
Previously, they were remanded for investigation under Section 302 of the Penal Code after they were arrested at Puncak Alam on May 31.
On Dec 6 last year, Zayn Rayyan was found dead in a stream near Idaman Apartment in Damansara Damai at around 10pm.
His body was found by a group of residents about 200m from his residential block after he was reported missing.
