Technician fined for outraging modesty of girl in lift

KUALA LUMPUR: A technician was fined RM5,000, or six months' jail, by the Sessions Court today for using criminal force to outrage the modesty of a 16-year-old girl in a condominium lift in March last year.

Judge Norshila Kamaruddin meted out the sentence on Alvin Kam Jee Wing, 24, after he pleaded guilty to an alternative charge for the offence.

The facts of the case read that Kam was in the lift with the girl who had returned home from school.

Kam touched the girl's shoulder, pushed her until she fell and tried to lift her blouse and touch her but she resisted.

When the lift stopped on the eighth floor, a woman saw them on the floor and the girl sought her help.

The woman sent the girl home and related the incident to her mother, who then met with the condominium's management to view the lift's closed circuit television camera recording.

A police report was made and Kam was arrested.

He was charged with committing the act at 2.22pm in the condominium lift on March 28 last year.

The offence under Section 354 of the Penal Code provides a maximum 10-year jail, fine or whipping or both upon conviction.

Earlier, in mitigation, Kam's lawyer, Wan Nur Afifah Che Bakar, said it was her client's first offence.

"He is single, he is repentant and apologises for his mistake. He promised not to repeat it.

"He is a technician earning RM2,400 monthly and contributes his income to his parents who are not working.

"I ask for him to be spared a jail sentence. He can afford to pay a fine of between RM3,000 and RM4,000," she said.

Deputy public prosecutor Nurfadzlin Mahmad Zulhasnan prosecuted.
