Jordanian brothers, company claim trial to service tax non-payment, SST submission delay

KUANTAN: Two Jordanian siblings along with their food company were hauled to the Sessions Court here to face 19 charges for allegedly failing to make service tax payments, and late sales and services tax (SST) statement submissions involving RM209,080.34.

Zamzam Arabic Food Holding Sdn Bhd along with siblings Rami Ahmad Mohammad Alsa'bi, 47, and Mohammad Ahmad, 55, pleaded not guilty to the charges before judge Sazlina Safie.

According to the charge sheet, the duo along with the company failed to pay the service tax within the stipulated duration and had delayed in submitting their SST statements to the Customs director-general.

They were alleged to have committed the offence involving the payments ranging between RM7,791 and RM23,899 at Wisma Kastam Sultan Ahmad Shah at Indera Mahkota here between Sept 2019 and August last year.

They were charged under Section 26(6)(a), Section 26(7) and Section 26(8) of the Service Tax Act 2018 where all three sections provide a fine not exceeding RM50,000 or imprisonment up to three years or both upon conviction.

The prosecution was conducted by Customs Department prosecuting officer Norhafizah Ahmad Razali while the brothers were represented by counsel Shahidan Baharom.

Shahidan said a letter of representation would be sent to the prosecution to review all the corruption charges against his client.

Sazlina fixed Nov 11 for mention.
