KOTA BARU: A fisherman was sentenced to one year in prison by the magistrate's court here yesterday for possessing a video of a woman defecating and obscene images on his mobile phone on Aug 26.
Muhamad Aiman Aqmal Mohammad, 23, pleaded guilty to two charges read before magistrate Rais Imran Hamid.
According to the charges, the accused was charged with insulting the modesty of a woman by possessing, and recording a video of a 48-year-old woman defecating in a toilet at a house with the intent to shame the victim at Pantai Pulau Kundur at 7.07am on May 31.
The offence is charged under Section 509 of the Penal Code, which carries a penalty of up to five years in prison or a fine, or both, upon conviction.
On the second charge, the accused was charged with possessing obscene images on his mobile phone.
The offence is under Section 292 of the Penal Code, which can result in a maximum prison term of three years or a fine, or both, upon conviction.
Both acts were allegedly committed on Jalan Kuala Besar Kampung Pulau Kundur here at 11.40pm on Aug 26.
The prosecution was conducted by Deputy Public Prosecutor Nursyafiqah Mohamad, while the accused was not represented by a lawyer.
Earlier, the accused, who works as a fisherman, requested a prison sentence.
However, Nursyafiqah urged the court to impose an appropriate sentence on the accused as his actions had humiliated the victim.
The court then sentenced the accused to one year in prison for the first charge and one year in prison for the second charge. The sentences were ordered to run concurrently from the date the accused was detained on Aug 26.
In a separate proceeding at the Sessions Court, the accused was also charged with committing sexual assault on a 12-year-old and nine-month-old girl on July 24.
However, the accused pleaded not guilty after the charge was read before Judge Nik Habri Muhamad.
