Court of Appeal rejects Muhyiddin's bid to restore DAA order

PUTRAJAYA: Former prime minister Tan Sri Muhyiddin Yassin will continue to face his four abuse of power charges linked to the Jana Wibawa programme at the Kuala Lumpur Sessions Court.

This is after his review application to restore his discharge amounting to an acquittal (DAA) order by the Kuala Lumpur High Court was dismissed by the Court of Appeal (CoA) today.

Lead lawyer Datuk Hisyam Teh Poh Teik said Muhyiddin was disappointed, but respected the decision of the panel led by judge Datuk Azizah Nawawi.

"The consequence is that Muhyiddin will go back again to the Sessions Court (Kuala Lumpur) where we will report the outcome of the proceedings today.

"We will further study the reasons given by the CoA. We need time to study the judgment concerned as to the next step to be taken and what are the legal avenues available."

Muhyiddin, who stood next to Teh, did not comment.

The 77-year-old Pagoh member of parliament had sought a review of a previous CoA panel's decision which unanimously granted the prosecution's application to set aside the Kuala Lumpur High Court's order to acquit and release him in August last year.

On Aug 15 last year, High Court judge Datuk Muhammad Jamil Hussin struck out the case linked to the Jana Wibawa programme, ruling that all the four charges against him were defective and in bad faith.
