TAWAU: Two boys, aged 13 and 14, have been charged with gang raping a 12-year-old girl at a farm here last week.
No plea was recorded for the boys charged in front of Tawau Court Assistant Registrar Mohd Afiz Huzairi Ayob.
They were charged under Section 376(2)(e) of the Penal Code for statutory rape without consent which was read together with Section 34 of the same act.
The section provides a jail term of between 10 and 30 years and whipping upon conviction.
The boys, who were unrepresented, are accused of gang raping the girl in a farm behind a house in Tawau on the night of Sept 26.
Deputy Public Prosecutor Batrisyia Mohd Khusri did not offer bail.
The court set Nov 21 for remention at the magistrate's court.
It was previously reported that three boys were arrested on suspicion of gang raping an underage girl.
Those arrested were known to the victim.
