High Court upholds acquittal of police officer in drug case

SEREMBAN: The High Court today upheld the Magistrate's Court's decision to acquit and discharge a police inspector of a drug-related charge from four years ago.

Judge Datuk Rohani Ismail dismissed the prosecution's appeal against the acquittal of Roslan Sam, 44, made on Nov 6, 2023.

The prosecution, led by deputy public prosecutor Nik Nur 'Aqilah Syarfa Nik Zaidi, filed the appeal on Nov 16, 2023. Roslan was represented by lawyers Haresh Mahadevan and Ramzani Idris.

Rohani, in proceedings held via video conference, ruled there was insufficient reason to overturn the lower court's decision.

Roslan had been charged with using and administering drugs, including ketamine and methamphetamine, at the Seremban police headquarters on Sept 27, 2020.

He was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952, which carries a fine of up to RM5,000 or a maximum two-year prison sentence.

The Magistrate's Court acquitted him after finding the prosecution failed to prove the case beyond a reasonable doubt.
