Prosecutor's office rejects representation from Customs officers accused of using drugs

BATU PAHAT: The magistrate's court here set three days in February next year for four Customs Department officers accused of using drugs in April.

Magistrate Suhaila Shafi'uddin set Feb 24, 26 and 27 for the trial of Norazmi Mohd Rashid, 40, Mohd Ruduan Yahya @ Yahaya, 43, Mohamad Safiq Basman, 24, and Salehudin Idres, 43.

The dates were set after the prosecution informed the court that the representation letters sent by the Customs officers to have their case dropped had been rejected by the State Prosecutor's Office.

Today's proceedings were held to determine the status of the representation.

Norazmi, Ruduan and Safiq had been charged with using amphetamines, menthylenedioxy-amphetamine (MDA) and methdylenedioxy-methamphetamine (MDMA).

They were charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 which carries a sentence of a fine of up to RM5,000 or imprisonment of a maximum of two years, or both, upon conviction.

Salehudin, meanwhile, was charged with using amphetamine, MDA and MDMA, also under Section 15(1)(a) of the same act, read together with Section 38B of the same.

Those convicted under Section 38B can be placed under police supervision and monitoring for not less than two years.

All the offences were alleged to have been committed at the Narcotics Crime Investigation Department of the Batu Pahat police headquarters between 6.40am and 7am on April 28.

Prosecution was handled by deputy public prosecutor Farah Wahidah Mohd Sharip, while the four accused were represented by Mohd Azlan Shah Mohd Allias.

It was reported that on April 28, police had raided an entertainment outlet in Batu Pahat where they detained 49 people, including 11 civil servants.
