Fruit seller gets 8 years jail for flashing teen daughter

MUAR: A 52-year-old man has been sentenced to eight years in jail and two strokes of the cane after he pleaded guilty to flashing his 14-year-old daughter.

The man, a fruit seller, made the plea before Sessions Court Judge Sayani Mohd Nor today.

According to the charge sheet, the father of two flashed his daughter after she came out of the bathroom of their home last month.

The man's wife and his other child, who were eating at the time, saw him flash the teenager. A report was lodged and the man was arrested on the same day.

Police found that the man had flashed his children on numerous occasions.

He was charged under Sections 15 (a) (1) and Section 16 of the Sexual Offences Against Children Act for non-physical sexual assault on a child and for an offence against a person in a relationship of trust.

Conviction under Section 15(a)(1) of the act is a maximum 10-year jail term or a fine of up to RM20,000 or both, while Section 16 imposes an additional penalty of five years imprisonment and at least two strokes of the cane.

The man, who was not represented, appealed for a lesser sentence, saying he had to look after his blind father.

The court sentenced him to six years in jail for the charge under Section 15 (a) (1) and two years in jail and two strokes of the cane for the charge under Section 16.

The man was also ordered to undergo counselling throughout his imprisonment and be placed under police supervision after he is released from prison.

Prosecution was handled by Deputy Public Prosecutor Danial Munir.
