KLANG: A businessman was fined RM4,600 by the magistrate's court today after pleading guilty to two charges of possessing pornographic videos of a woman showering on his mobile phones.
Magistrate Siti Zubaidah Mahat sentenced Chai Kien Tung, 29, to three months in jail if he failed to pay the fine, which he later settled.
Chai was charged with committing both offences at 12.30am at the control room of a condominium in Kota Bayuemas yesterday. (Nov 4).
The charges under Section 292 of the Penal Code carry a maximum penalty of three years in prison, a fine, or both.
According to the facts of the case, the victim was showering in the toilet when she noticed a mobile phone with its camera pointed at her from the next stall.
She reviewed the CCTV footage with the condominium management, which showed Chai running out of the toilet.
Suspecting he had filmed her, she filed a report, leading to Chai's arrest and the seizure of his phones.
Deputy public prosecutor Nuruljannah Aimi urged the court to impose a deterrent sentence, calling Chai's actions immoral.
In mitigation, defence lawyer Nur Husnina Ahmad said that Chai earned RM2,000 a month and supported his parents and grandmother.
She said that it was his first offence and that he was remorseful, apologising for his actions and promising not to repeat them.
She also said that Chai had been remanded and had learned a lesson from the experience.
"I believe only he possessed the videos and it was not shared with anyone," she added.
