Friction marks found on Zaharif's clothing after fatal hit-and-run, says witness

IPOH: The High Court here today was told that there were signs of friction and tears found on Muhammad Zaharif Affendi Muhd Zamrie's clothing after the victim was hit and run over by a Perodua Ativa driven by a senior police officer in December last year. 

A teenage boy, who was the 10th prosecution witness, said at the time of the incident, he and four of his friends were standing by the roadside not far from the site of the incident.

The boy said during the incident, the victim, who was 17 at the time, was wearing a black and pink physical education outfit from Sekolah Menengah Kebangsaan Jati and long pants. 

The witness provided his testimony during cross-examination by lawyer M. Athimulan before Judge Datuk Bhupindar Singh Gucharan Singh Preet on the sixth day of the trial. 

Athimulan: When Zaharif was thrown onto the road, you saw Zaharif. What was he wearing at the time? 

Witness: Physical education clothes in black and pink.

Athimulan: Short or long pants? 

Witness: Long.

Athimulan: Wearing shoes or slippers? 

Witness: Don't remember.

Athimulan: When you approached Zaharif, did you try to help, touch, or lift him? 

Witness: No.

Athimulan: When you saw Zaharif on the road, did you see that his shirt or pants were torn? 

Witness: Yes.

Athimulan: Were there any signs or marks of friction on the clothing? 

Witness: Yes.  

The witness also said he saw the car and a Yamaha LC motorcycle that Zaharif rode moving from Muhammad Al-Fateh Mosque towards the school junction before the collision occurred.  

Athimulan: Before you saw the Ativa and the motorcycle ridden by Zaharif collide, did you see both vehicles coming from the mosque?

Witness: I saw both vehicles. 

Athimulan:

Witness: Approximately five to 10 metres.

Asked if he'd previously seen the victim ride the motorcycle to school, the witness answered that he had seen it occasionally, but was unsure whether the victim had ever revved his motorcycle before the incident. 

He said as soon as the collision occurred, he did not notice the damage to the victim's motorcycle because his attention was focused on Zaharif, who had been thrown onto the road. 

 "I did not record the incident. I did not have my mobile phone at the time and I am not sure if other people recorded it or not," he said. 

Mohd Nazri Abdul Razak, 45, was charged with murdering Zaharif on Jalan Taman Jati 1, near Sekolah Menengah Kebangsaan Jati, between 11.45 am and 12.40 pm on Dec 15, 2023. 

He was charged under Section 302 of the Penal Code for murder, which carries the death penalty or imprisonment of between 30 and 40 years, with a minimum of 12 strokes of the cane upon conviction. 

The accused was represented by lawyers M. Athimulan, Datuk Meor Faridalathrash Wahid, and Aiman Hakim Kamaruzzaman, while the prosecution team is made up of Deputy Public Prosecutors Afzainizam Abdul Aziz, Nasrul Hadi Abdul Ghani, V Suloshani and Low Qin Hui.
