ALOR STAR: A cleaner has been fined RM80,000 after he was found guilty by the Sessions Court here today of distributing obscene and pornographic videos for commercial purposes earlier last year.
The accused, Kamarulnazri Desa @ Yahaya, 45, received the sentence after pleading guilty to the charges read by a court interpreter before Judge Mazdi Abdul Hamid.
According to the charges, Kamarulnazri was accused of using the X application account "@Ayie_Noryn2016" to transmit obscene and pornographic videos intended to offend others on Jan 26 and Feb 4.
He was also charged with distributing the videos via Telegram links titled "SU: GROUP Collection 4th and 6th" for commercial purposes on Feb 8 and 17.
The content was discovered by authorities at the Kubang Pasu district police headquarters, Jitra, on Feb 20.
The accused was charged under the Communications and Multimedia Act 1998, which carries a maximum penalty of RM50,000, a maximum one-year imprisonment, or both, upon conviction.
Case facts revealed that Kamarulnazri sold group sex videos for RM100, with payment receipts found by authorities.
During sentencing, the prosecution was led by deputy public prosecutor Fatin Hadni Khairuddin from the Malaysian Communications and Multimedia Commission (MCMC), while the accused was unrepresented.
In his plea for leniency, Kamarulnazri requested a lighter sentence, citing his job as a cleaner earning RM1,500 per month, his responsibility to support his wife and four children (two of whom are university students), and his role in caring for his ailing grandmother.
However, the prosecution urged the court to impose a heavy sentence, given the nature of the content, which included videos promoting group sex activities, some involving his wife with another man while he watched.
These videos were sold to the public, and MCMC investigations revealed that the accused had uploaded a large collection of such videos on social media platforms since 2016.
The prosecution argued for a severe penalty to deter the accused and others involved in such activities, particularly due to the potential exposure of this content to children.
The judge imposed an RM80,000 fine, with a two-year imprisonment in default of payment.
As of 4pm today, the accused had failed to pay the fine and will be sent to Pokok Sena prison to serve the default sentence.
