IPOH: The High Court here was informed today that the memory card from the dashcam of a Perodua Ativa, belonging to senior police officer Deputy Superintendent Mohd Nazri Abdul Razak, was accessed four days after the collision that killed a teen two years ago.
However, no recordings were found on the dashcam memory card that captured the collision between the accused, Mohd Nazri, and the motorcycle ridden by the victim, Muhammad Zaharif Affendi Muhd Zamrie.
This was stated by the 33rd prosecution witness, a senior investigating officer, Assistant Superintendent S. Dasarathan, 46, from the district Criminal Investigation Department here.
Dasarathan said on Dec 20, 2023, he instructed the previous investigating officer, Inspector Jong Pit Chao, to re-examine the vehicle to verify whether it was equipped with a dashcam.
"I was informed that the inspection revealed a set of dashcam equipment, including a memory card, placed in the dashboard of the Perodua Ativa.
"I directed Inspector Jong to seize the dashcam. I then received one set of dashcam equipment and a memory card from her.
"I conducted a preliminary examination of the dashcam and memory card and found that no recordings were made or existed on Dec 15, 2023.
"However, my preliminary examination was not conclusive and required further forensic analysis," he said before judge Datuk Bhupindar Singh Gucharan Singh Preet.
He said based on the forensic laboratory analysis report on the dashcam memory card, the police successfully retrieved 130 video files dated from Nov 4, 2022, to Dec 19, 2022.
"The recordings only cover up to Dec 19, 2022, and no recordings were made between Dec 20, 2022, and Dec 15, 2023.
"There is no recording of the incident (the collision between the Perodua Ativa and the motorcycle ridden by Zaharif).
"This was confirmed by evidence showing that the Perodua Ativa's dashcam had been removed during the installation of window tint on the car earlier," he said.
However, Dasarathan said that the forensic report also revealed that the memory card was accessed on Dec 19, 2023, one day before the evidence was discovered.
Nazri, who is represented by M. Athimulan, Datuk Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman, faces the death penalty or imprisonment of 30 to 40 years, with a minimum of 12 strokes of the cane, if convicted.
Nazri is accused of murdering Zaharif by running over the teen with his Perodua Ativa after knocking the 17-year-old from the teen's motorcycle.
The prosecution team comprises deputy public prosecutors Afzainizam Abdul Aziz, Nasrul Hadi Abdul Ghani and Low Qin Hui.
The trial continues on Tuesday.
