Penang condo residents lose bid to challenge development decision by MBPP

GEORGETOWN: Residents of the Sunrise Garden Condominium in Sungai Ara here have failed in their bid to challenge the Penang Island City Council (MBPP) board’s decision to develop a project next to their property.

High Court judge Lim Chong Fong said the MBPP board had made their decision according to the law and their jurisdiction.

Lim also ordered the respondents to pay legal costs of RM25,000.

During mitigation, lawyer Datuk Lakhbar Singh, who represented the residents, said that the court must take into consideration the public’s interest in the case.

However, Lim explained that the court’s decision was based on the judicial review to challenge the decision by the MBPP board and not the residents’ concerns over the proposed project.

Sunrise Condominium resident committee representative, Manuel Nicholas, when met outside the court room, said the residents are devastated by the court’s decision and will discuss their next course of action.

When asked whether they plan to appeal the case, Manuel said the residents have one month to decide and will make a decision after they have thoroughly discussed the matter.
