Govt to draft new act allowing house detention

KUALA LUMPUR: The government will draft a new act to allow house detention as an alternative punishment for certain offences.

Prime Minister Datuk Seri Anwar Ibrahim said that under the proposed law, offenders would be required to remain in designated locations such as their homes, care centres, or workers' dormitories for the duration of their sentence.

"This measure will provide an alternative to traditional incarceration, focusing on rehabilitation while ensuring that offenders remain under close supervision," he said when tabling the 2025 Budget today.

Prominent lawyer Mohamed Haniff Khatri Abdulla said the new act could help ease prison overcrowding nationwide.

He said house detention is suitable for criminals found guilty of petty offences that disrupt public order.

"This can be a good alternative option available to those who were found guilty of petty offences such as drunk driving or vandalism.

"They can be detained at their house and will not disturb society, while also freeing up space in prison for more serious offenders," he said when contacted.

He said this option could also be considered for white-collar criminals, provided they have settled the fines imposed by the court.

"White-collar crimes usually involve public funds.

"If the offenders settle their fines, house detention can also be applied to help ease prison congestion," he added.
