Interim report on separation of powers between AG, public prosecutor expected next year

PUTRAJAYA: An interim report on the separation of powers between the Attorney-General (AG) and the Public Prosecutor is expected to be presented to the cabinet soon.

Communications Minister Fahmi Fadzil said several engagement sessions with the relevant stakeholders will be conducted next year.

"The Madani government remains committed to reforming the role of the AGl through empirical studies on the separation of powers between the AG and the Public Prosecutor.

"This study began this year with empirical research in Australia and Canada, as well as several rounds of roundtable discussions with legal experts, academics and civil society organisations both domestically and internationally," he said during his weekly press conference today.

Previously, Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said stated that the interim report on the separation of powers is expected to be completed next year.

On a separate matter, Fahmi said the appointment of Datuk Mohd Dusuki Mokhtar as the new AG was made in line with Article 145(1) of the Federal Constitution.

"The Yang di-Pertuan Agong (Sultan Ibrahim) has consented to his appointment, effective Nov 12, and it is in line with the Constitution.

"His appointment as AG is also based on his extensive experience in the field of prosecution, having served for 31 years in the legal service at the Attorney-General's Chambers," he said.

Mohd Dusuki was appointed as the new AG, effective Nov 12, replacing Tan Sri Ahmad Terrirudin Mohd Salleh, who has been appointed as a Federal Court Judge.

However, his appointment has been questioned by several parties, including opposition member of parliament Datuk Seri Mas Ermieyati Samsudin.
