Govt rolls out new guidelines for flexible work arrangements

KUALA LUMPUR: The Human Resource Ministry (Kesuma) has launched the Flexible Work Arrangement (FWA) guidelines as part of the government's ongoing efforts to empower employees and help employers optimise human resources and operational costs.

In a statement, the ministry said the guidelines align with the enforcement of the Employment Act 1955 (Amendment) 2022 under Sections 60P and 60Q, which grant employees the right to request FWAs to meet current needs and adapt to technological advancements.

The ministry said the guidelines encompass all key elements that all parties, especially employees and employers, need to be aware of, including definitions, methods for implementing FWAs, application procedures, and the responsibilities of both employees and employers in the process.

"Kesuma, through strategic collaboration with the Peninsular Malaysia Labour Department (JTKSM) and Talent Corporation Malaysia Berhad (TalentCorp), will continue to provide guidance and support on FWA implementation based on the suitability of time, place, and target groups. In fact, through this collaboration, Kesuma is confident that it can disseminate information widely and enhance understanding among all parties regarding the importance of FWAs, thereby ensuring the success of efforts to normalise FWAs across all fields and types of employment," it said.

Kesuma also highlighted its openness to receiving suggestions for improvement from all relevant stakeholders to ensure the continued enhancement of FWA implementation and its alignment with the needs of the modern workforce.

"JTKSM and TalentCorp have long taken proactive steps to promote FWAs, and this initiative has received highly encouraging responses from industry players and stakeholders. As of October 2024, a total of 2,826 organisations and 565,210 employees have embraced FWAs, highlighting their transformative potential. Therefore, Kesuma urges all parties to continue supporting FWA implementation to foster a culture of work-life balance," it said.
