Bina Darulaman unit sued for stray golf balls spanning five years

KUALA LUMPUR: Bina Darulaman Bhd and its subsidiaries are facing a lawsuit for stray golf balls spanning a five-year period.

Bina Darulaman runs a 18-hole golf resort in Jitra,Kedah.

According to a Bursa Malaysia Securities filing yesterday, the lawsuit pertains to the alleged deprivation of use and enjoyment of Mohd Nazli's property due to stray golf balls entering his premises, causing loss and damage over the past five years since 2019.

Mohd Nazli is seeking RM1 million in general damages, as well as special damages, including RM3 million in exemplary damages and another RM3 million in aggravated damages.

The action was filed by Mohd Nazli Ahmad Mahyadin through the law firm Messrs Nashitoh Kassim & Associates against Bina Darulaman,  BDB Darulaman Golf Resort Bhd and BDB Land Sdn Bhd.

"The directors have instructed its solicitors to take all appropriate legal actions to defend the interests, good standing and innocence of BDB and its subsidiaries."

"The case management was fixed on Aug 4, 2024 in which both parties agreed to proceed with mediation for this case."This case is scheduled for mediation on Sept 26, 2024 at Pusat Mediasi Mahkamah Alor Setar," the filing said.

Bina Darulaman last traded unchanged at 34 sen a share, giving it a market capitalisation RM100.25 million.
