KUALA LUMPUR: The Malaysian Aviation Commission (Mavcom) has filed charges against BCS Aviation (Sarawak) Sdn Bhd and its director, Datuk Seri Robert Song Tung Wei, for 60 offences linked to conducting refuelling operations without a valid Ground Handling Licence (GHL).
This was issued by the commission at the Sessions Court in Kuching, Sarawak.
BCS Aviation was charged with 30 offences under section 37(1) of the Malaysian Aviation Commission Act 2015 [Act 771], while Robert Song was charged for the same 30 offences under section 37(1) read together with section 92(2)(b) of Act 771 in his capacity as a Director of BCS Aviation.
The alleged acts occurred at North Pan Hangar, Kuching International Airport, between July 29 and Aug 18, 2019.
According to Mavcom, Both BCS Aviation and Robert Song claimed trial to all charges.
"The charges were read to both the Accused in four separate Sessions Courts in Kuching, Sarawak on Dec 4, 2024, where the respective Sessions Court Judges, Puan Iris Anak Awen Jon, Puan Afidah binti Abdul Rahman, Tuan Musli bin Ab Hamid and Tuan Saiful Bahari bin Adzmi granted undeposited bail at RM30,000 with 2 local sureties to Robert Song." "Meanwhile, the representative of BCS Aviation, Datuk Akim Matrang, was required to execute a bond of attendance in the amount of RM5,000 (undeposited) for each case," it said.
If convicted, they each face a maximum fine not exceeding RM1 million, or imprisonment term of not exceeding 3 years, or both.
Mavcom executive chairman Datuk Seri Saripuddin Kasim said the commission emphasises the importance of complying with industry laws and regulations, which are essential for operating in the aviation sector.
"All aviation players must secure all necessary regulatory approvals before commencing operations, as mandated by both Malaysian law and international standards."
