E-cigarette liquid with nicotine falls under Drugs Act 1952: Health ministry

KUALA LUMPUR : E-cigarette liquids containing nicotine are required to be registered as per the Control of Drugs and Cosmetics Regulation 1984, and Sale of Drugs Act 1952, said the Health Ministry today.

Its director-general Datuk Dr Noor Hisham Abdullah said on his Facebook status that e-cigarette liquids can only be supplied by licensed pharmacists and registered medical practitioners and their sale has to be recorded.

"According to the Poisons Act 1952, the sale of nicotine by other parties is unlawful.

On Oct 30th, the cabinet has made a decision not to ban electronic cigarettes and vape.

"However, e-liquids containing nicotine and other substances listed under the Poisons List are highly regulated under the Poisons Act 1952 and the Dangerous Drugs Act 1952," he said.

It was reported today that a final verdict on vaping will be discussed by a special task force under the ministry.

The final internal meeting will look into measures to address the issue of e-cigarettes.
