KUALA LUMPUR: The High Court has struck out a suit by Yayasan Pembangunan Anak Yatim/Miskin (Foundation for the Advancement of Orphans and the Poor, or Pemangkin) against Yayasan Pembangunan Ekonomi Islam Malaysia (Yapeim) and six others over misconduct and efforts to shut down the foundation.
In allowing Yapeim's application, judicial commissioner Datin Faizah Jamaludin ruled that the issues raised in the suit by Pemangkin were frivilous and vexatious.
The seven who succeeded in their striking out application, apart from Yapeim, were Datuk Shahlan Ismail, 59, Mohd Yusof Abd Rahman, 62, Mokhtar Abdul Razak, 59, Datuk Abibullah Samsudin, 58, Sharina Ramli and Normala Embi, 54.
However, minister in the Prime Minister's department Datuk Seri Jamil Khir Baharom who was named as the first defendant in the suit did not file an application to strike out Pemangkin's suit.
On March 1, Pemangkin founder Datuk Mohd Yusoff A Bakar, 65, and Ahmad Fazil Hashim, 61, filed the suit naming the eight as defendants.
In their statement of claim, the duo had sought for a declaration that Pemangkin was a standalone entity and not a subsidiary of any company or foundation or other establishment including Yapeim.
They had also sought a declaration that instructions and action by Jamil Khir and the seven others to make Pemangkin a dormant company was illegal.
The two who are the plaintiffs in the suit had also sought for Jamil Khir to pay RM10,680,000 which was the management fee for a programme called SANTUN and RM90,000 for the management fee of another programme called SINAR KASIH for the year 2016.
Among others, they had also sought for all the defendants to return RM770,000 which was alleged to have been misappropriated for the programmes which they claimed was illegal.
