KUALA LUMPUR: Serba Dinamik Holding Berhad, its director and two of its senior officers were charged at the Sessions Court here with submitting a false statement to Bursa Malaysia Securities Bhd (Bursa Malaysia).
The company, its non-independent executive director Datuk Syed Nazim Syed Faisal, 41, group financial controller Azhan Azmi, 39, and Accounts and Finance vice president Muhammad Hafiz Othman, 37, pleaded not guilty to the offence.
They were charged at two separate Sessions Court here today.
The four were accused of submitting a false statement with an intent to deceive Bursa Malaysia in relation to the affairs of the company contained in its quarterly report last year.
They allegedly committed the offence at Bursa Malaysia office near Bukit Kewangan here on Feb 26 this year.
The offence falls under Section 367(1) of the Capital Markets and Services Act 2007 which carries a maximum 10 years' imprisonment and RM3 million fine upon conviction.
The company was represented by its independent non-executive director Abu Bakar Uzair before Judge Hamidah Mohamed Deril.
Meanwhile, Judge Datin Sabariah Othman set RM300,000 bail with two sureties for each of the three accused.
Sabariah also ordered the trio to surrender their passports and report once a month at the nearby Securities Commission's office.
Deputy public prosecutors Hashley Tajudin and Zulaida Zulkifli prosecuted while counsel L. K. Mak represented all the accused.
The court fixed Jan 27 next year for hearing.
