BANGI: Five food delivery riders were jointly charged today with the murder of a motorist in Taman Pelangi Semenyih 2 on Feb 20.
The accused were Syamsul Qamar Ayob, 40, Mahazir Nordin, 43, Azharul Azuan Mohd Azan, 34, Tengku Izham Tengku Hamid, 22 and Mohd Yuree Ranoff Mohd Bachuri, 41
No plea was recorded after the charge was read out before Magistrate Nurdiyanah Mohd Nawawi at the Bandar Baru Bangi magistrate's court as the case comes under the jurisdiction of the High Court.
When asked if they understood the charges against them, all five accused nodded.
According to the charge sheet, the five were allegedly to have murdered Shahril Samad, a self-employed man at Jalan TPS 2/3 Taman Pelangi, Semenyih, at 9.54pm on Feb 20.
They were charged under Section 302 for murder read together with Section 34 of the Penal Code for each of several persons liable for an act done by all, in like manner as if done by him alone.
Under Section 302 of the Penal Code, if found guilty, one shall be punished with death or imprisonment for a term of not less than thirty years but not exceeding forty years and if not sentenced to death, shall also be punished with whipping of not less than twelve strokes.
No bail was given and the court fixed April 25 for the submission of forensic status, chemical and post-mortem examination reports.
Deputy public prosecutor Siti Nur Liyana Mohd Sulaiman prosecuted while lawyer Mohd Hafiz represented all the five accused.
Meanwhile, a man believed to be the victim's relative had shouted to the accused: "Bang, kau tunggu! (Just you wait!)" after the proceedings concluded.
The man was calmed down before police escorted him out of the court.
Last Wednesday, it was reported that a 42-year-old motorist, whose car had collided with a food delivery rider's motorcycle, was beaten to death by members of the public.
According to reports, following the collision with the motorcyclist, the man was chased by members of the public to Taman Pelangi Semenyih 2, before his car skidded and crashed into a fence.
Reports claimed that the man was dragged out of his car and had his hands and feet tied before he was assaulted.
Police later detained five men aged between 22 and 52 in the Semenyih and Beranang areas to assist in the investigation.
Police also arrested two more men, aged 22 and 39, in Kajang, suspected of being involved in the incident.
