KUALA TERENGGANU: The Sessions Court here sentenced a labourer to 30 years' imprisonment and 30 strokes of the cane on three counts of raping his disabled daughter, to the point that she bore his child.
Judge Mohd Zul Zakiqudin Zulkifli meted out the sentence after the 45-year-old pleaded guilty to all three charges.
On the first count, he was charged with raping the victim, then 12, at a house in Dungun some time in 2022.
On the second and third counts, he was charged with repeating the offence at the same place some time last year and this year.
The judge sentenced the accused to 10 years' jail and 10 lashes for each of the three charges which were framed under Section 376(3) of the Penal Code.
Zul Zakiqudin ordered the sentences to be served consecutively from the date of arrest, on July 21 this year.
However, the accused will only be given 24 strokes of the cane as that is the maximum allowed under Section 288 of the Criminal Procedure Code.
Prosecution was conducted by deputy public prosecutor Intan Nor Hilwani Mat Rifin while the accused was not represented.
The media had reported previously that police had arrested a man to facilitate investigations into the rape of his daughter after the child gave birth to a child on July 20.
The victim had complained of a stomachache and was brought to a clinic by her mother.
They were shocked when the doctor who examined her said she was pregnant. She gave birth shortly after, about 7pm.
