Four acquitted of drug rap by Alor Star High Court after 6 years

ALOR STAR: Four men regained their freedom after almost six years when the Alor Star High Court on Thursday acquitted all of them over a drug-related offence in 2018.

The four accused - Ahmad Fauzi Sulaiman, 48, Muhamad Zaidi Mohd Salleh, 52, Muhamad Fakulrozi Mat, 33, and Abdul Halim Samat, 28, - were acquitted by High Court Judge Evawani Farisyta Muhammad after she found discrepancies in their case.

The judge said the chain of information related to the evidence in the case was broken, if not compromised. She also pointed out that the prosecution had failed to produce any explanation for the matter to the court.

The four, who lived around the same place in Pendang, Kedah were arrested on Aug 26, 2018, at an unnumbered house in Kampung Alor Besar, Mukim Bukit Raya, at 12.10am, for alleged possession and drug trafficking. They were jointly accused of the possession of 90.90 grams of methamphetamine.

They were charged under Section 9B(1)(a) of the Dangerous Drugs Act 1952 and Section 39B(2) of the same Act. The charges were read together with Section 34 of the Penal Code for allegedly selling and distributing drugs.

Fauzi was represented by lawyer Mohd Fadhly, Yoocob, Zaidi and Fakulrozi were both represented by lawyer Datuk Shanmugam Ganesan, while Halim was represented by Burhanudeen Abdul Wahid.
