KUALA LUMPUR: The Attorney-General's Chambers (A-GC) will object to Muhammed Yusoff Rawther's legal bid to challenge his denial of bail after being charged with drug offences recently.
The former research assistant's lawyer, Muhammad Rafique Rashid Ali, said the prosecution indicated this intention during a court hearing before High Court judge Datuk Wan Ahmad Farid Wan Salleh today.
He also said the court fixed Jan 20 for the next case management.
Yusoff is seeking a declaration that Section 41B of the Dangerous Drugs Act is unconstitutional as it limits the powers of the court to consider or grant bail to an accused.
He has been under remand at the Sungai Buloh Prison awaiting trial after being charged under the same section with trafficking cannabis on Sept 12.
Yusoff, who has an ongoing civil lawsuit against Prime Minister Datuk Seri Anwar Ibrahim over an alleged sexual assault, was arrested on Sept 6 after police allegedly found two pistols and 305g of marijuana in the car he was travelling in.
He was charged with trafficking 305g of cannabis and pleaded not guilty to the offence before magistrate M.S. Arunjothy.
The drug charge, under Section 39B of the Dangerous Drugs Act, carries a life sentence and no fewer than 12 strokes of the cane.
On Oct 9, Yusoff pleaded not guilty before magistrate S. Mageswary to possessing two imitation guns in Jalan Bukit Kiara on Sept 6.
He was charged under Section 36(1) of the Arms Act 1960, which carries a one-year jail term, a maximum RM5,000 fine, or both, upon conviction.
