MyPPP president granted full authority over party assets after Federal Court decision

KUALA LUMPUR: The People's Progressive Party (MyPPP) president, Datuk Dr J. Loga Bala Mohan, has been granted full authority to oversee the party's assets following the Federal Court's dismissal of the final legal challenge.

A three-member bench, led by the Chief Judge of Sabah and Sarawak, Tan Sri Abdul Rahman Sebli, rejected an application for leave to appeal by former MyPPP president Tan Sri M. Kayveas, who sought to intervene in a legal dispute over party assets.

The court ruled unanimously that Kayveas failed to meet the legal threshold required under Section 96 of the Courts of Judicature Act 1964. Abdul Rahman stated that the four legal questions posed by Kayveas did not involve novel or significant constitutional matters of public interest.

The panel, which also included judges Datuk Abdul Karim Abdul Jalil and Datuk Ahmad Terrirudin Salleh, ordered Kayveas to pay RM30,000 in costs to MyPPP.

The legal tussle originated in 2019 when MyPPP was deregistered by the Home Ministry. During the deregistration period, movable and immovable party assets managed by its economic entity, Bintang Iradat Sdn Bhd, were allegedly transferred to Kayveas Holdings Sdn Bhd.

After the Home Ministry lifted the deregistration in March 2022, Datuk Seri Maglin Dennis D'Cruz was reinstated as MyPPP's lawful president. He subsequently filed a lawsuit seeking the return of party assets, including Wisma PPP in Kampung Attap and 100,000 shares in Bintang Iradat.

The High Court granted a vesting order in August last year, enabling MyPPP to reclaim its properties. However, Maglin passed away in November last year, and Loga was elected as MyPPP president in September this year.

Kayveas then sought to intervene in the vesting order but was unsuccessful in the High Court and the Court of Appeal. His attempt to bring the case to the Federal Court was dismissed today, marking the end of the legal battle.

Lawyer Gavin Anand Jayapal represented Loga in the proceedings, while Kayveas, who is also a lawyer, represented himself and Kayveas Holdings.
