MACC to appeal against revision of Phee's remand order

GEORGE TOWN: The Malaysian Anti-Corruption Commission (MACC) will be appealing against the George Town High Court's revision today of State Environment committee chairman Phee Boon Poh's five-day remand order.

In a statement issued this afternoon, the MACC said it respects the High Court's decision to set aside the remand order for Phee, as well as for a 70-year-old factory manager and his 37-year-old son, which was issued by a magistrates' court here on Saturday.

"However, the MACC is not happy with the decision by judicial commissioner Datuk Abdul Wahab Mohamed to set aside the remand order, and will be appealing to the Court of Appeal.

"We take this (issue) seriously, as the decision affects the investigation process of our officers, who are working hard to complete the investigation papers on Phee and the two others," the statement read.

Earlier today, Wahab set aside the remand order, after finding that the applicants had been denied their right to be heard.

On Saturday, the magistrate's court here granted a five-day remand order against Phee and the father-son duo to facilitate a probe into an illegal factory in Sungai Lembu.

The remand order, which would have ended on Wednesday, was issued by senior deputy registrar Ameera Mastura Khamis.

The remand was to facilitate the MACC’s probe under Section 23 of the MACC Act 2009 for abuse of power for gratification.

On Sunday, Phee's lawyers applied for a revision of the order at the Alor Star High Court, but it was turned down.
