The late Zulfarhan's father once wanted to sue UPNM

KUALA LUMPUR: The father of the late Zulfarhan Osman revealed that he had initially intended to take legal action against the administration of the National Defence University of Malaysia (UPNM) in 2022.

However, Zulkarnain Idros said his intention was thwarted by bureaucratic delays from certain parties.

"I filed a summon against UPNM, but due to bureaucratic delays from certain parties, the summon had expired.

"The deadline for filing the suit is three years from the date of the incident and the legal action was carried out through my lawyer at the time," he said to BH.

Meanwhile, in a radio interview today, Zulkarnain said none of the offenders, who caused the death of his son, came to apologise since the incident.

He said only the accused who were charged under Act 330 and released without the need for defence had come forward to apologise.

"The offender's parents have never come forward to apologise to us, even though we have encountered them several times in court."

"For seven years, from the High Court to the Court of Appeal, we encountered and sometimes brushed shoulders, but there was no apology," he said.

Zulkarnain also expressed his appreciation to the individual who sent the anonymous letter to the warden, to bring attention to his late son's situation.

"I'm grateful to the person who sent the anonymous letter, they did everything they could to help my son.

"If this person has some time, I would like to meet in person or arrange a meeting at a convenient time," he said.

On Tuesday, the Court of Appeal sentenced six former UPNM cadets to death for the murder of navy cadet Zulfarhan, seven years ago.

The court described the case as the "rarest of the rare".

A three-member bench comprising Datuk Hadhariah Syed Ismail, Mohamed Zaini Mazlan and Datuk Azmi Ariffin unanimously allowed the prosecution's appeal to reinstate a charge under Section 302 of the Penal Code and impose the death penalty.

The court also set aside the previous 18-year jail sentence.

The six are Muhammad Akmal Zuhairi Azmal, Muhammad Azamuddin Mad Sofi, Muhammad Najib Mohd Razi, Muhammad Afif Najmudin Azahat, Mohamad Shobirin Sabri and Abdoul Hakeem Mohd Ali, who are now 28 years old.
