KUALA LUMPUR: A policeman said he saw bruises on Emilia Hanafi's body when recording her domestic violence report on Nov 22, seven years ago.
Corporal Mahmood Riad Mohd Noor, who manned the Sri Hartamas police station front desk that day, said Emilia had come to the police station twice, to lodge a police report about being hit by her then husband, Datuk SM Faisal SM Nasimuddin Kamal.
He said she came in the evening and later at midnight, and was distressed and had been crying both times while saying she had been hit and choked by her then husband.
Mahmood said his work shift was between 4pm and midnight that day. However, he had received last-minute instructions from a superior officer to record Emilia's statement.
"She was showing the bruises on her body, on her first visit. I then brought her to Triage Service and was instructed by the police chief to issue a police instruction for her to seek further medical treatment.
"She then came again at midnight, with another woman. She was, again, in distress and was brought to the Triage Service room to calm down.
"I saw obvious injuries on Emilia's body, as I recorded her statement that night.
"There were bruises, but I couldn't recall where it was on the body," he said when reading out his witness statement in court.
The 43-year-old policeman said he proceeded to record Emilia's statement at 12.37am, on Nov 23.
SM Faisal's lawyer Datuk Akberdin Abdul Kader later asked the witness on the police report lodged by SM Faisal, around an hour after Emilia had lodged hers.
Akberdin suggested to Mahmood that there was another policeman by the name of Constable Ngu Tien Tien who had clocked in after his shift and recorded SM Faisal's police report at 1.32 am.
The witness agreed with the suggestion when he was shown a copy of the said police report, in which it stated that SM Faisal and his then wife had a miscommunication on Nov 22, which led to a physical altercation and both were injured in the alleged fight.
Following this, the witness also agreed with Akberdin's suggestions that both SM Faisal and Emilia's police reports were given to the same investigating officer known only as "Puan Rosnani" for further investigations.
SM Faisal is charged with voluntarily causing hurt to Emilia, 43, at a house in Desa Sri Hartamas, Brickfields here, between 12.30pm and 4.30pm on Nov 22, 2015.
He is charged under Section 323 of the Penal Code and punishable under Section 326A of the same code, which provides a maximum jail term of two years, a maximum fine of RM2,000 or both, upon conviction.
The trial before magistrate Nadia Othman continues.
