Motorcyclist who went against traffic and killed a man pleads insanity [NSTTV]

KUALA LUMPUR: The individual who went against the traffic flow and killed a man last month pleaded insanity at the magistrate's court, here, this morning.

Magistrate Amalina Basirah Md Top ordered Mudzyadaha Mohammad to be sent to Hospital Bahagia Ulu Kinta in Perak for a mental evaluation.

This comes after National Legal Aid Foundation (YBGK) Izleen Ismail informed the court that the 41-year-old individual has a mental disability, has accepted assistance from the Welfare Department (JKM) and holds an OKU card.

Earlier, Mudzyadaha pleaded guilty to one count of driving his motorcycle against the flow of traffic even after taking into account all possible risks posed to the public and therefore causing the death of another motorcycle rider Ahmad Fadzil Omar Azaddin.

He was accused of committing the offence at KM22.2 of the Sungai Besi Ulu Kelang Highway (SUKE) near Ulu Kelang, around 1.10pm on June 14.

His charge was framed under Section 41(1) of the Road Transport Act 1987 which carries a five to 10 years jail term and fine between RM20,000 and RM50,000, and driving licence suspended for five years, upon conviction.

Deputy Public Prosecutor (DPP) Annur Athirah Amran suggested for the court to order RM15,000 bail on the accused as well as surrender the accused's passport to court and to report himself to the nearest police station once a month.

Izleen then rebutted by pleading for a lower amount of bail and made the application for the accused to be sent to Hospital Bahagia.

She also said that the accused, who used to work as a train driver and lorry driver, had lost his job and went into depression.

She said Mudzyadaha was also a father of three and his wife was not working.

Annur Athirah did not object to the application.

The magistrate then ordered RM10,000 bail on the accused and for him to report to a police station near his house once a month.

She also ordered for the accused's driving license to be surrendered to court and fixed Aug 10 for mention.

It was previously reported that on June 14, a Ducati Panigale rider Ahmad Fadzil Omar Azzadin, 62, was thrown off an elevated highway while attempting to avoid a motorcyclist, who was riding against the flow of traffic at 1.05pm at KM22.2 of the Sungai Besi Ulu Kelang Highway (SUKE) near Ulu Kelang.

Fadzil was reported to have gone through a bend when he swerved to avoid the oncoming motorcyclist. The victim then crashed into a divider before he was flung 30m down the elevated flyover. He was pronounced dead at the scene.
