KOTA KINABALU: A Bruneian was fined RM10,000 in default 60 days' jail for overstaying in Sabah.
Md Norazwan Md Anarul Adelludin,27, who pleaded guilty to the charge was in tears when seeking leniency before Sessions Court judge Norhafizah Mohd Salim.
He said he was unemployed and the incident taught him a lesson.
He also told the court that he was traumatised and was mentally affected after he was arrested and remanded.
Norazwan was arrested on April 28 at 3.30pm at the Kota Kinabalu Police Commercial Crime Division after producing his visit pass, which had expired on Nov 13, last year.
Norazwan had overstayed in the state for more than six months.
He entered the country on Oct 13, last year, and was only allowed in the country for 30 days.
The purpose of Norazwan's visit to Sabah or his activities during his stay, however, was not disclosed during the open court proceedings.
Staying in Malaysia beyond the allowed period is a violation of Section 15(1)(c) of the Immigration Act 1959/63, which carries a fine of at least RM10,000, or a jail term of up to five years, or both, upon conviction.
The court ordered Norazwan to be referred to the Immigration Department for further action.
Deputy public prosecutor Nurul Shafeerah Mad Iskim, who prosecuted the case, urged the court to impose a deterrent sentence.
It was learnt that the accused failed to pay his fine.
